Earnest

Thing given to bind a bargain, showing the parties to be in earnest; a mode of binding the contract, and not nece ary to pa title. Under the statute of frauds it must be given outright, not handed to the seller and returned, nor put into a third person's hands to be forfeited upon a contingency.
