In Law, the investigation before an unofficial person of the matters in difference between contending parties. His judgment is called an award. The reference to him may be made, whether loyal proceedings concerning the question referred have hern instituted 01 not. The reference is made by writing under seal or otherwise, and even by parole agreements, but in this latter case the submi ion cannot, as in the others, rule of court. ( .) [s. 84]
