PENALTY (Lat. poena, punishment), is of three kinds, says Lorcl Coke; poena pecuniaria, poena corporal is, and poena exilii. Vv here any thing is prohibited by statute under a penalty, if the penalty, or part of it, be not appointed by the statute to the informer, it goes to ihe crown.
