Title given by Urban VIII. to Cardinals 1630. Eminent Domain. Sovereign power of a State to take private property for public use. In the U. S. the power is generally exercised by State governments, but within constitutional limits it may be exercised by the Federal government. The State cannot divest itself of this power. Whether a particular use is public is a question for the courts; whether it is proper or wise to take particular property for a public use is a question for the jury. IMG:content-1306.jpg:[graphic]
