In Law, a beast is said to be so, when found in another person's ground without his leave or licence; in which case the tenant may distrain or impound it:but at his own peril, if the accident have happened through his own negligence in not repairing the fences of his close. Po e ion, without title, is sufficient to empower the tenant to distrain damagefeasant. Proper notice is, however, to be given; and if the owner of the estate tender amends, it is unlawful to detain them. Da' [s. 330]
