TALES

InLaw. If by reason of challenges or other causes a sufficient number of jurors do not appear at a trial, either party may pray a tales; that is, may pray the sheriff (since 6 G. 4. c. 50. the judge at the trial) to allow a sufficient number of qualified men who happen to be present (tales cir cums tanti bus) to be joined with the other jurors to make up the twelve. In practice this seldom arises, except in tlie case of special jury trials, when the talesmen are taken from the common j ury panel in the same court. See Jury. [s. 1219]
